Fixsonic reserves the right to change this policy at any time so please check this page before contacting us
or when in doubt. Fixsonic strives to provide the best possible service to all our customers, but we will not
tolerate unlawful activity or abuse of our services. We respect freedom of speech on recordings unless it
is harmful to others. Fixsonic reserves the right to deny services on any project. These brief guidelines are
imposed to protect you, the customer, and us from such harm.
Payment, Policies and Fees
To keep our costs down and to stream line our work flow, Fixsonic has implemented the following policies

A minimum charge of $20 applies to all projects to cover the cost of analysis. Each project
must have an analysis performed in order to establish what needs to be done to repair or convert
the recording(s).

An estimate will be provided to the customer upon request after the analysis is completed.
Fixsonic cannot be held responsible for estimates given over the phone as the condition (physical, electronic,
or otherwise) of the media
to be repaired or converted cannot be established. If you ask for an estimate over the phone, it will
be a ballpark guess based on other projects of similar type and is not bound to your project in any way
shape or form.

In the event of a project resulting in a computer readable format (such as wav, mp3, mpeg, etc.) Fixsonic
will notify the customer that the project has been completed and provide a sample via electronic means.
The customer must pay Fixsonic in full before the project resultant will be delivered either physically on
media or electronically via download or email.

Customer assumes full responsibility and knowingly acknowledges that the media to be converted, repaired or
otherwise recorded is in no wise in violation of US Copyright laws. For more information see Title 17 at the

The cost of shipping your original media will be included in the final cost of the project and provided during
the estimate phase of the project upon request. Fixsonic will in no wise be held reponsible for damage to media
sent electronically or by other ground/air means. Customer accepts full responsibility for insuring media prior
to delivery to Fixsonic. Fixsonic reserves the right to deny any project based upon the physical or electronic
condition of given media.

Fixsonic will not provide services on pornographic or otherwise offensive/harmful materials. Any materials received by
Fixsonic deemed by Fixsonic to be poronographic or otherwise offensive/harmful will not be returned and will be destroyed.
Fixsonic reserves the right to report said materials to authorities.

Due to rapid changes in technology, Fixsonic cannot be responsible for media that will not play in outdated consumer
equipment such as CD players, DVD players, etc.

Customer agrees to pay Fixsonic in full within 30 days of notification of project completion unless otherwise
agreed between Fixsonic and the customer. Accounts that are overdue will be charged a weekly fee of $10.

A $50 fee will be charged for checks issued without sufficient funds (bounced checks).

Residents of Ohio must pay a 7.5% sales tax for services rendered.
Indemnification Policy
You agree to use all Fixsonic services at your own risk. Fixsonic specifically disclaims all warranties
of merchantability and fitness for a particular purpose. In no event shall Fixsonic be liable for any loss,
loss of data, or other commercial damage including but not limited to special, incidental, consequential or
other damages. This includes equipment malfunction resulting in damaged media.
Customer agrees that it shall defend, indemnify, save and hold Fixsonic harmless
from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted
against Fixsonic, its agents, its customers, officers and employees, that may arise or result
from any service provided or performed or agreed to be performed.
Customer agrees to defend, indemnify and hold harmless Fixsonic against liabilities arising out of:
- Any injury to person or property caused by any products sold or otherwise distributed in connection with Fixsonic;
- Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
- Copyright infringement
Fixsonic reserves the right to amend these Terms and Conditions at any time and without notice.
